Voss, Kristal

Age when convicted:

28

Year convicted:

Age of infant/child at death (weeks):

Charge theory:

SBS

Year exonerated/released:

2017

Years incarcerated:

13

Later explanation:

FALL

Additional information:

Colorado SBS/AHT case. Hospital and coroner (Dr Robert Bux) attributed Kyran’s subdural and retinal haemorrhages and brain swelling to violent shaking, rejecting Ramirez’s account that the baby fell from his shoulders onto ice/floor. Trial defence accepted SBS and only tried to blame Ramirez. Post‑conviction experts later found the injuries and timing consistent with an accidental fall, and the court ruled that counsel’s failure to challenge SBS and present fall evidence was ineffective; after 13 years in prison, Voss’s conviction was vacated and charges dismissed in 2017. False or misleading forensic evidence plus inadequate defence.
